(Legal)
These terms apply when you buy from the GRAPHIQ shop or hire GRAPHIQ STUDIO LLC ("GRAPHIQ", "we", "us") for a project, and when you use graphiq.art. By paying in the shop, or by accepting a written quote, you agree to them. We kept them as plain as we could — if anything is unclear, ask us before you buy: hello@graphiq.art.
What you can buy
- Be found. Get found on AI and on Google: a monthly subscription at $400 a month, billed on the same day each month until you cancel.
- Content. Campaign work, paid once: One campaign $1,000 · Campaign + ads $2,500 · Full launch $5,000. Ad spend is paid to the ad platforms directly and is not part of the price.
- Build. A fixed-price build, paid in full up front: Website $1,500 · SaaS $4,000 · Scaled apps & sites $8,000.
- Systems. Automations, AI agents and RAG training are priced on inquiry. You get a written quote with the scope, price and timeline; that quote applies together with these terms, and where they differ, the quote wins.
Prices are in US dollars. Any tax that applies is shown at checkout before you pay.
How a project runs
After you pay, you get an email with a short brief to fill in and, for builds and campaigns, a link to book a kickoff call. The brief, as we agree it at the kickoff, says what is included; work starts at the kickoff (for Be found, once we have your brief). Anything outside the brief is quoted separately before we do it, and we only go ahead once you have said yes in writing.
Your part: send the content, access and feedback the project needs, on time. If we wait on you, the timeline moves by the same amount. If we cannot reach you for 60 days, we may close the project; you keep everything delivered up to that point.
We work with a small team of trusted specialists and contractors. They are bound to keep your project confidential, and we stay responsible to you for their work.
Payments
Payments are processed by Stripe. Your card details go straight to Stripe and never touch our servers. You receive a receipt by email for every payment. If a subscription payment fails, we may pause the service until it is paid.
What we collect when you buy or send an inquiry, and why, is set out in our Privacy Policy.
Cancelling a subscription
You can cancel Be found at any time in the customer portal (sign in with the email you paid with), or by writing to hello@graphiq.art. The cancellation takes effect at the end of the month you have already paid for, and the service runs until then. You will not be charged again.
Refunds
- Before work starts. If you change your mind within 14 days of paying and before the kickoff, you get a full refund — for one-time projects and for the first month of Be found.
- After work has started. Payments for work already done are not refundable. If we cannot deliver what the brief describes, we refund the part that was not delivered.
- Subscriptions. Apart from the first month as above, monthly payments are not refunded for part of a month; cancelling stops the next one.
- Third-party costs. Money spent on your behalf — ad spend, domains, hosting, paid tools, licences or stock media — cannot be refunded once it has been spent.
To ask for a refund, write to hello@graphiq.art with your receipt. Approved refunds go back to the card or account you paid with, through Stripe; banks usually show them within 5–10 business days. If something went wrong, please talk to us before opening a chargeback — it is almost always faster.
These refund rules add to any withdrawal or refund rights you have as a consumer under the law where you live; they never take them away.
Your materials and your accounts
- Your materials. You confirm that you have the right to use everything you send us — text, photos, logos, data and trademarks — and that using it in your project does not infringe anyone else's rights.
- Your content and your business. You are responsible for the facts, offers and prices about your business, and for the legal texts your site or system needs (for example your own privacy policy, imprint, cookie notice or industry rules), unless we agree in writing to prepare them. Please check everything before launch; your go-ahead to launch counts as your approval of what goes live.
- Your accounts after handover. We deliver on accounts in your name. After handover, you are responsible for those accounts, their passwords and access, backups, renewals and third-party fees (hosting, domains, databases, paid tools). Changes made by you or anyone else after handover are outside our responsibility.
Ownership
Once you have paid in full, you own the final deliverables we made for you: the designs, copy, media and code written for your project. We keep ownership of our own tools, templates, components and know-how that existed before or are reused across projects, and you get a permanent licence to use them as part of what we delivered. Third-party parts (open-source code, fonts, plugins, stock media) stay under their own licences.
We may show the finished work in our portfolio and case studies, unless you ask us in writing not to.
AI in our work
We use AI tools in our work — among them Claude (by Anthropic), ChatGPT (by OpenAI) and other AI tools for code, writing, images, video and audio. They help us research, design, write, produce and build faster. People at GRAPHIQ direct the work and review everything before it reaches you.
- Your material. We share with AI providers only what a task needs, and we do not put your confidential material into tools that use it to train third-party models.
- Originality. We take reasonable care that what we deliver does not copy other people's work.
- Copyright in AI-assisted work. Some laws, including in the United States, do not protect purely AI-generated material by copyright. You get every right we hold in your deliverables, but we cannot guarantee that each AI-assisted element can be protected or registered as your own intellectual property.
Updates and maintenance
Our own products, Clausign and Fregio, are under active development. They receive regular updates, maintenance and security fixes, and features may be added, changed or retired as they improve. Where a product publishes its own terms on its own site, those terms govern its use.
What we build for you runs on software and services that keep changing — browsers, frameworks, plugins, hosting platforms and third-party APIs — so it needs care over time. If something we delivered does not work as the agreed brief describes, tell us within 30 days of delivery and we will fix it at no extra cost. Ongoing maintenance after that is included only where your subscription or a written agreement says so; we are happy to quote it.
Third-party services
Projects rely on services we do not control — for example Stripe, Vercel and other hosting providers, domain registrars, ad platforms, app stores and AI providers. Their own terms apply to your use of them, and we are not responsible for their outages, price or policy changes, or decisions they make about your account. If one of them changes in a way that affects your project, we will help you adapt; work beyond the brief is quoted first.
Confidentiality and data
Anything non-public you share with us for a project stays confidential and is used only for that project, during and after it.
If your project means we handle personal data on your behalf — for example your customers' data in a system we build or run — we process it only on your instructions and to deliver the project, and we will sign a data processing agreement on request. How we handle our own visitors' and clients' data is set out in our Privacy Policy.
Results and warranties
We do the work with care and skill. We cannot promise outcomes that depend on others — search rankings, being cited in AI answers, ad performance, traffic, sales or app-store approval — because platforms, algorithms and markets decide those. Anything we say about likely results is an estimate based on experience, not a guarantee.
Apart from what these terms or your written quote expressly promise, our deliverables, our products and this website are provided "as is" and "as available". To the extent permitted by law, we disclaim all other warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we do not promise that anything will run uninterrupted or error-free.
Liability
As far as the law allows, our total liability for any claim connected with these terms, a project or our products is limited to what you paid us in the 12 months before the claim, and we are not liable for indirect or consequential losses such as lost profits, revenue, data or business opportunities.
To the extent permitted by law, you agree to cover our reasonable costs, including legal fees, if someone makes a claim against us because of material you gave us, or because of how you use the deliverables in breach of these terms or the law.
Nothing in these terms limits liability that the law does not allow to be limited — for example for intent, gross negligence, or death or personal injury caused by negligence — or takes away rights you have as a consumer under mandatory law.
Things outside our control
We are not responsible for delays or failures caused by events beyond our reasonable control — for example outages of third-party services, internet or power failures, cyberattacks, natural disasters, illness, war or government action. If such an event stops a project for more than 30 days, either of us may end it; you keep what was delivered, and we refund what you paid for work not yet done.
Ending a project
We may decline or stop work that would be unlawful, misleading or harmful, or if you seriously breach these terms — for example by not paying, or by abusive conduct towards our team. If we stop a project for a reason that is not your fault, we refund the part that was not delivered.
Using this website
The content on graphiq.art, including our blog, is for general information. It reflects our experience at the time of writing and may become outdated; it is not legal, financial or other professional advice. Code samples in our posts are provided as is, for learning. Links to other sites, such as our clients' sites, are there for your convenience, and we are not responsible for their content.
Please don't misuse the site, for example by trying to break into it, overload it or scrape it.
Changes and law
We may update these terms; the version on this page when you paid applies to that purchase. GRAPHIQ STUDIO LLC is a New Mexico limited liability company, and these terms are governed by the laws of the State of New Mexico, United States. If there is a disagreement, we will first try to settle it with you directly and in good faith; if that fails, the state and federal courts in New Mexico have jurisdiction. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in your local courts where that law allows it.
These terms, together with your written quote and the agreed brief, are the whole agreement between us about your purchase. If any part of them is found unenforceable, the rest still applies. If we don't enforce a right straight away, we haven't given it up.
